Angajatorii din Boto\u0219ani care vor aduce str\u0103ini sunt obliga\u021bi s\u0103 le pl\u0103teasc\u0103 salariul doar \u00een cont, s\u0103 le predea curs de limba rom\u00e2n\u0103 \u0219i s\u0103 r\u0103spund\u0103 pentru \u00eentregul lor parcurs<\/span><\/h2>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">\u00cen Monitorul Oficial din 27 aprilie 2026 a fost publicat\u0103 Ordonan\u021ba de Urgen\u021b\u0103 nr. 32\/2026, care schimb\u0103 fundamental regimul angaj\u0103rii cet\u0103\u021benilor str\u0103ini \u00een Rom\u00e2nia. Actul normativ, intrat deja \u00een vigoare, impune angajatorilor o serie de responsabilit\u0103\u021bi noi, de la plata exclusiv \u00een cont bancar p\u00e2n\u0103 la organizarea de cursuri de limba rom\u00e2n\u0103. Reprezentan\u021bii ITM Boto\u0219ani transmit c\u0103 sunt disponibili s\u0103 sprijine firmele locale \u00een aplicarea noilor prevederi.<\/span><\/strong><\/p>\n<h4><span class=\"\">Angajatorul \u2013 r\u0103spunz\u0103tor pentru tot<\/span><\/h4>\n<p class=\"ds-markdown-paragraph\"><span class=\"skip-quote-patch\">Dac\u0103 p\u00e2n\u0103 acum principala grij\u0103 a angajatorului era ob\u021binerea avizelor pentru angajarea unui str\u0103in, odat\u0103 cu OUG 32\/2026, firma devine responsabil\u0103 pentru \u201e\u00eentregul parcurs al lucr\u0103torului str\u0103in\u201d. Noutatea absolut\u0103 este obligativitatea \u00eenregistr\u0103rii pe platforma\u00a0<\/span><strong><a href=\"https:\/\/workinromania.gov.ro\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span class=\"\">WorkinRomania.gov.ro<\/span><\/a><\/strong><span class=\"\">, cu excep\u021bia unor categorii expres prev\u0103zute de lege.<\/span><\/p>\n<h4><span class=\"\">Ce obliga\u021bii concrete au angajatorii din Boto\u0219ani?<\/span><\/h4>\n<ol start=\"1\">\n<li>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">Plata se face doar \u00een cont bancar<\/span><\/strong><span class=\"\">\u00a0\u2013 interzis la salariu \u00een numerar pentru str\u0103ini.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">Contract de munc\u0103 \u00een dou\u0103 limbi<\/span><\/strong><span class=\"\">\u00a0\u2013 at\u00e2t \u00een rom\u00e2n\u0103, c\u00e2t \u0219i \u00een limba de origine sau \u00eentr-o limb\u0103 interna\u021bional\u0103 pe care str\u0103inul o \u00een\u021belege.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">Clauze obligatorii \u00een contract<\/span><\/strong><span class=\"\">\u00a0\u2013 de la func\u021bie \u0219i durata muncii, p\u00e2n\u0103 la taxe, sporuri, concediu \u0219i chiar desp\u0103gubiri pentru accidente de munc\u0103.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">Curs de limba rom\u00e2n\u0103 \u0219i integrare cultural\u0103<\/span><\/strong><span class=\"\">\u00a0\u2013 timp de minimum 6 luni, c\u00e2te 6 ore pe s\u0103pt\u0103m\u00e2n\u0103. Angajatorul poate asigura cursurile direct sau prin parteneri acredita\u021bi.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">Obliga\u021bii de raportare<\/span><\/strong><span class=\"\">\u00a0\u2013 \u00een termen de 5 zile lucr\u0103toare, angajatorul trebuie s\u0103 notifice Imigr\u0103rile \u0219i agen\u021bia de plasare la orice absen\u021b\u0103 nemotivat\u0103 mai mare de 3 zile, \u00eencetarea contractului sau situa\u021bii de exploatare.<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">P\u0103strarea documentelor timp de 5 ani<\/span><\/strong><span class=\"\">\u00a0\u2013 inclusiv copii ale documentelor de c\u0103l\u0103torie\/\u0219edere.<\/span><\/p>\n<\/li>\n<\/ol>\n<h4><span class=\"\">Schimbarea angajatorului \u2013 blocat\u0103 6 luni<\/span><\/h4>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Una dintre cele mai importante modific\u0103ri vizeaz\u0103 mobilitatea lucr\u0103torului str\u0103in.\u00a0<\/span><strong><span class=\"\">Acesta nu poate ini\u021bia singur schimbarea angajatorului timp de 6 luni<\/span><\/strong><span class=\"\">\u00a0de la \u00eenceperea activit\u0103\u021bii. Excep\u021biile sunt extrem de restr\u00e2nse (\u00eenc\u0103lcarea grav\u0103 a contractului de c\u0103tre angajator).<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Mai mult, timp de 2 ani, schimbarea angajatorului se poate face\u00a0<\/span><strong><span class=\"\">doar prin intermediul aceleia\u0219i agen\u021bii de plasare<\/span><\/strong><span class=\"\">.<\/span><\/p>\n<p class=\"ds-markdown-paragraph\"><strong><span class=\"\">Ce se \u00eent\u00e2mpl\u0103 dac\u0103 str\u0103inul pleac\u0103 mai devreme?<\/span><\/strong><span class=\"\">\u00a0Angajatorul are dreptul s\u0103 recupereze:<\/span><\/p>\n<ul>\n<li>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">sumele investite \u00een cursurile de limba rom\u00e2n\u0103 \u0219i integrare,<\/span><\/p>\n<\/li>\n<li>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">cheltuielile de cazare \u0219i transport.<\/span><\/p>\n<\/li>\n<\/ul>\n<h4><span class=\"\">Obliga\u021biile \u0219i ale str\u0103inului<\/span><\/h4>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Legea nu vine doar cu sarcini pentru angajatori. Str\u0103inul angajat trebuie s\u0103 respecte clauzele contractului, regulile de securitate \u00een munc\u0103 \u0219i s\u0103 furnizeze informa\u021bii reale despre calific\u0103ri. De asemenea,\u00a0<\/span><strong><span class=\"\">are obliga\u021bia de a p\u0103r\u0103si Rom\u00e2nia<\/span><\/strong><span class=\"\">\u00a0dac\u0103 i-a expirat dreptul de \u0219edere \u00een scop de munc\u0103.<\/span><\/p>\n<h4><span class=\"\">Sprijin din partea ITM Boto\u0219ani<\/span><\/h4>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Conducerea Inspectoratului Teritorial de Munc\u0103 Boto\u0219ani &#8211; <\/span><strong><span class=\"\">Daniela Petronela Lozneanu (inspector-\u0219ef)<\/span><\/strong><span class=\"\">\u00a0\u0219i\u00a0<\/span><strong><span class=\"\">Alina Pahone (inspector-\u0219ef adjunct)<\/span><\/strong><span class=\"\"> &#8211; a transmis c\u0103 institu\u021bia este deschis\u0103 s\u0103 ofere suport angajatorilor \u0219i angaja\u021bilor str\u0103ini.<\/span><\/p>\n<blockquote>\n<p class=\"ds-markdown-paragraph\"><em><span class=\"skip-quote-patch\">\u201eNe manifest\u0103m disponibilitatea de a sprijini at\u00e2t angajatorii, c\u00e2t \u0219i angaja\u021bii cet\u0103\u021beni str\u0103ini, prin oferirea unui suport constant \u0219i a unor informa\u021bii actualizate privind legisla\u021bia \u00een vigoare, astfel \u00eenc\u00e2t raporturile de munc\u0103 s\u0103 se desf\u0103\u0219oare \u00een condi\u021bii corecte \u0219i conforme cu prevederile legale\u201d,<\/span><\/em><span class=\"\"> au declarat reprezentan\u021bii ITM.<\/span><\/p>\n<\/blockquote>\n<p class=\"ds-markdown-paragraph\"><span class=\"\">Pentru firmele din jude\u021bul Boto\u0219ani care inten\u021bioneaz\u0103 sau deja angajeaz\u0103 for\u021b\u0103 de munc\u0103 din afara UE,\u00a0<\/span><strong><span class=\"\">OUG 32\/2026 aduce costuri semnificative \u0219i un risc juridic major<\/span><\/strong><span class=\"\">\u00a0\u00een caz de neconformare.
