Amend\u0103 6.000 de lei dac\u0103 nu traduc contractul \u00een limba angajatului"},"content":{"rendered":"<h2><strong>Modific\u0103ri majore \u00een Codul Muncii pentru angajarea str\u0103inilor: ITM Boto\u0219ani avertizeaz\u0103 angajatorii<\/strong><\/h2>\n<p>Inspectoratul Teritorial de Munc\u0103 Boto\u0219ani a transmis un comunicat important privind schimb\u0103rile aduse Codului Muncii prin <strong><span tabindex=\"0\" role=\"button\" data-url=\"ca:\/\/s?q=Detalii_OUG_32_2026\">O.U.G. nr. 32\/2026<\/span><\/strong>, act normativ care reglementeaz\u0103 accesul cet\u0103\u021benilor str\u0103ini pe pia\u021ba muncii din Rom\u00e2nia. Ordonan\u021ba, publicat\u0103 \u00een Monitorul Oficial pe 27 aprilie 2026, a intrat \u00een vigoare la aceea\u0219i dat\u0103 \u0219i introduce obliga\u021bii suplimentare pentru angajatori, precum \u0219i noi situa\u021bii de \u00eencetare de drept a contractelor de munc\u0103.<\/p>\n<h2><strong>Contracte de munc\u0103 obligatoriu bilingve pentru salaria\u021bii str\u0103ini<\/strong><\/h2>\n<p>Una dintre cele mai importante modific\u0103ri vizeaz\u0103 modul de redactare a contractelor individuale de munc\u0103. Angajatorii sunt obliga\u021bi s\u0103 \u00eencheie contractul:<\/p>\n<ul>\n<li>\u00een <strong>limba rom\u00e2n\u0103<\/strong>,<\/li>\n<li><strong>\u0219i<\/strong> \u00een limba statului de origine al lucr\u0103torului str\u0103in <strong>sau<\/strong> \u00eentr-o limb\u0103 de circula\u021bie interna\u021bional\u0103 pe care acesta o \u00een\u021belege.<\/li>\n<\/ul>\n<p>Nerespectarea acestei obliga\u021bii constituie contraven\u021bie \u0219i se sanc\u021bioneaz\u0103 cu <strong>amend\u0103 de 6.000 lei pentru fiecare contract<\/strong> redactat exclusiv \u00een limba rom\u00e2n\u0103.<\/p>\n<p>Aceast\u0103 prevedere urm\u0103re\u0219te s\u0103 asigure transparen\u021b\u0103 \u0219i \u00een\u021belegerea corect\u0103 a drepturilor \u0219i obliga\u021biilor de c\u0103tre lucr\u0103torii str\u0103ini.<\/p>\n<h2><strong>Certificatul medical \u2013 excep\u021bie temporar\u0103 pentru angaja\u021bii str\u0103ini<\/strong><\/h2>\n<p>Codul Muncii prevede c\u0103 orice persoan\u0103 poate fi angajat\u0103 doar pe baza unui certificat medical care atest\u0103 aptitudinea pentru munc\u0103. O.U.G. nr. 32\/2026 introduce o derogare:<\/p>\n<ul>\n<li><strong>str\u0103inii pot fi angaja\u021bi f\u0103r\u0103 prezentarea certificatului medical<\/strong>,<\/li>\n<li>\u00eens\u0103 documentul trebuie ob\u021binut <strong>cel t\u00e2rziu p\u00e2n\u0103 la data \u00eenceperii activit\u0103\u021bii<\/strong>.<\/li>\n<\/ul>\n<p>Aceast\u0103 flexibilizare are scopul de a accelera procedurile de angajare \u00een contextul deficitului de for\u021b\u0103 de munc\u0103.<\/p>\n<h2><strong>Dou\u0103 noi situa\u021bii de \u00eencetare de drept a contractului de munc\u0103<\/strong><\/h2>\n<p>Ordonan\u021ba introduce dou\u0103 cazuri suplimentare \u00een care contractul individual de munc\u0103 \u00eenceteaz\u0103 automat:<\/p>\n<h3>1. <strong>Respingearea cererii unice<\/strong><\/h3>\n<p>Definit\u0103 \u00een legisla\u021bia privind regimul str\u0103inilor, respingerea cererii unice duce la \u00eencetarea de drept a contractului. Angajatorul emite decizia pe baza notific\u0103rii primite prin platforma <strong>WorkinRomania.gov.ro<\/strong>.<\/p>\n<h3>2. <strong>Constatarea \u0219ederii ilegale \u00een Rom\u00e2nia<\/strong><\/h3>\n<p>Dac\u0103 Inspectoratul General pentru Imigr\u0103ri constat\u0103 \u0219ederea ilegal\u0103 a lucr\u0103torului str\u0103in, angajatorul este obligat s\u0103 emit\u0103 decizia de \u00eencetare a contractului la primirea notific\u0103rii oficiale.<\/p>\n<p>Aceste prevederi \u00eent\u0103resc controlul asupra legalit\u0103\u021bii \u0219ederii \u0219i muncii str\u0103inilor \u00een Rom\u00e2nia.<\/p>\n<h2><strong>Ce trebuie s\u0103 con\u021bin\u0103 contractul individual de munc\u0103 al lucr\u0103torului str\u0103in<\/strong><\/h2>\n<p>O.U.G. nr. 32\/2026 define\u0219te explicit <strong><span tabindex=\"0\" role=\"button\" data-url=\"ca:\/\/s?q=Contract_munca_straini\">contractul de munc\u0103 al str\u0103inului<\/span><\/strong> \u0219i stabile\u0219te elementele obligatorii, care trebuie s\u0103 coincid\u0103 cu oferta ferm\u0103 transmis\u0103 anterior angaj\u0103rii.<\/p>\n<p>Printre elementele obligatorii se num\u0103r\u0103:<\/p>\n<ul>\n<li>func\u021bia, meseria \u0219i cerin\u021bele postului;<\/li>\n<li>durata angaj\u0103rii \u0219i condi\u021biile de \u00eencetare;<\/li>\n<li>timpul de munc\u0103 \u0219i repaus;<\/li>\n<li>salariul brut\/net, tariful orar \u0219i modalitatea de plat\u0103;<\/li>\n<li>sporuri \u0219i alte drepturi salariale;<\/li>\n<li>durata concediului de odihn\u0103;<\/li>\n<li>condi\u021biile de munc\u0103 \u0219i m\u0103surile de SSM;<\/li>\n<li>taxele \u0219i contribu\u021biile aplicabile;<\/li>\n<li>desp\u0103gubiri \u00een caz de accidente, boli profesionale sau deces.<\/li>\n<\/ul>\n<h2><strong>Cazarea, transportul \u0219i repatrierea \u2013 clarificate \u00een ofert\u0103<\/strong><\/h2>\n<p>Oferta ferm\u0103 trebuie s\u0103 precizeze clar dac\u0103 anumite beneficii sunt suportate de angajator sau de lucr\u0103tor:<\/p>\n<ul>\n<li><strong>cazarea<\/strong> \u0219i condi\u021biile acesteia;<\/li>\n<li><strong>transportul<\/strong> din \u021bara de origine, transportul zilnic la locul de munc\u0103 \u0219i condi\u021biile de repatriere;<\/li>\n<li>acoperirea costurilor \u00een caz de accident, boal\u0103 profesional\u0103 sau deces.<\/li>\n<\/ul>\n<p>Aceste prevederi urm\u0103resc protejarea lucr\u0103torilor str\u0103ini \u0219i prevenirea abuzurilor.<\/p>\n<p>Modific\u0103rile introduse prin O.U.G. nr. 32\/2026 reprezint\u0103 un pas important \u00een reglementarea muncii str\u0103inilor \u00een Rom\u00e2nia.
