Potrivit <strong data-start=\"465\" data-end=\"511\">Legii nr. 367\/2022 privind Dialogul Social<\/strong>, negocierea colectiv\u0103 este obligatorie la nivelul unit\u0103\u021bilor cu cel pu\u021bin 10 angaja\u021bi, precum \u0219i la nivel de sector de negociere colectiv\u0103, \u00eens\u0103 \u00eenregistrarea contractelor se face numai dac\u0103 sunt respectate toate cerin\u021bele legale.<\/p>\n<h3 data-start=\"746\" data-end=\"804\">Unde se \u00eenregistreaz\u0103 contractele colective de munc\u0103<\/h3>\n<ul data-start=\"805\" data-end=\"1023\">\n<li data-start=\"805\" data-end=\"863\">\n<p data-start=\"807\" data-end=\"863\">la <strong data-start=\"810\" data-end=\"817\">ITM<\/strong>, \u00een cazul contractelor la nivel de unitate;<\/p>\n<\/li>\n<li data-start=\"864\" data-end=\"1023\">\n<p data-start=\"866\" data-end=\"1023\">la <strong data-start=\"869\" data-end=\"914\">ministerul responsabil cu dialogul social<\/strong>, pentru contractele la nivel de grupuri de unit\u0103\u021bi, sectoare de negociere colectiv\u0103 sau la nivel na\u021bional.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1025\" data-end=\"1257\">Acestea devin aplicabile de la data \u00eenregistr\u0103rii sau de la o dat\u0103 ulterioar\u0103, stabilit\u0103 prin conven\u021bia p\u0103r\u021bilor. Contractele colective de munc\u0103 la nivel na\u021bional \u0219i de sector sunt publicate \u00een <strong data-start=\"1219\" data-end=\"1254\">Monitorul Oficial, Partea a V-a<\/strong>.<\/p>\n<h3 data-start=\"1259\" data-end=\"1301\">Motivele respingerii la \u00eenregistrare<\/h3>\n<p data-start=\"1302\" data-end=\"1401\">ITM precizeaz\u0103 c\u0103 exist\u0103 mai multe situa\u021bii \u00een care contractele colective nu pot fi \u00eenregistrate:<\/p>\n<ol data-start=\"1402\" data-end=\"2388\">\n<li data-start=\"1402\" data-end=\"1682\">\n<p data-start=\"1405\" data-end=\"1682\"><strong data-start=\"1405\" data-end=\"1424\">Dosar incomplet<\/strong> \u2013 lipsesc documente precum: contractul colectiv \u00een original, dovezi privind convocarea p\u0103r\u021bilor la negociere, \u00eemputerniciri pentru reprezentan\u021bi, procese-verbale ale negocierii, mandatele speciale prev\u0103zute de lege sau dovada reprezentativit\u0103\u021bii p\u0103r\u021bilor.<\/p>\n<\/li>\n<li data-start=\"1683\" data-end=\"1970\">\n<p data-start=\"1686\" data-end=\"1970\"><strong data-start=\"1686\" data-end=\"1744\">Neinvitarea tuturor p\u0103r\u021bilor \u00eendrept\u0103\u021bite la negociere<\/strong> \u2013 legea impune ca angajatorul, \u00een termen de 15 zile de la ini\u021bierea negocierii, s\u0103 convoace toate p\u0103r\u021bile \u0219i s\u0103 organizeze prima \u0219edin\u021b\u0103 de negociere. Lipsa dovezii privind invitarea tuturor p\u0103r\u021bilor duce la ne\u00eenregistrare.<\/p>\n<\/li>\n<li data-start=\"1971\" data-end=\"2130\">\n<p data-start=\"1974\" data-end=\"2130\"><strong data-start=\"1974\" data-end=\"2023\">Lipsa semn\u0103turilor reprezentan\u021bilor mandata\u021bi<\/strong> \u2013 contractele pot fi validate doar dac\u0103 sunt semnate de persoanele \u00eemputernicite legal de fiecare parte.<\/p>\n<\/li>\n<li data-start=\"2131\" data-end=\"2388\">\n<p data-start=\"2134\" data-end=\"2388\"><strong data-start=\"2134\" data-end=\"2170\">Absen\u021ba clauzelor pentru IMM-uri<\/strong> \u2013 contractele colective la nivel de sector sau na\u021bional trebuie s\u0103 prevad\u0103 dispozi\u021bii specifice pentru \u00eentreprinderile mici \u0219i mijlocii. \u00cen lipsa acestora, IMM-urile nu au obliga\u021bia de a aplica contractul respectiv.<\/p>\n<\/li>\n<\/ol>\n<h3 data-start=\"2390\" data-end=\"2437\">Clarific\u0103ri pentru angajatori \u0219i angaja\u021bi<\/h3>\n<p data-start=\"2438\" data-end=\"2707\">ITM Boto\u0219ani subliniaz\u0103 c\u0103 respectarea acestor reguli este esen\u021bial\u0103 pentru ca un contract colectiv de munc\u0103 s\u0103 fie valid \u0219i aplicabil.
