<\/strong><\/p>\n<p><strong>Pentru angajatori cu privire la prevederile Legii nr.367\/2022 privind dialogul social, cu modific\u0103rile \u0219i complet\u0103rile ulterioare<\/strong><\/p>\n<p>Legea nr. 367\/2022 privind Dialogul Social, prevede c\u0103 <strong>negocierea colectiv\u0103 este obligatorie la nivelul unit\u0103\u021bilor care au cel pu\u021bin 10 angaja\u021bi\/lucr\u0103tori.<\/strong>\u00a0\u00cen cazul \u00een care intr-o unitate nu exist\u0103 contract colectiv de munc\u0103, angajatorul sau orice alt\u0103 persoan\u0103 \u00eendrept\u0103\u021bit\u0103 \u00a0s\u0103 participe la negocierea colectiv\u0103, conform prezentei legi, poate ini\u021bia negocierea contractului colectiv de munc\u0103 \u00een orice moment(art.108, alin.3 din Legea nr. 367\/2022).<\/p>\n<p>Pentru angaja\u021bi, negocierea colectiv\u0103 genereaz\u0103 avantaje multiple precum:\u00a0mai mult\u0103 justi\u021bie social\u0103, drepturi superioare privind condi\u021biile de munc\u0103 \u0219i de angajare, salariile, securitatea \u0219i s\u0103n\u0103tatea \u00een munc\u0103, aplicarea principiului egalit\u0103\u021bii de \u0219anse \u0219i tratament, protec\u021bie suplimentar\u0103 \u00een exercitarea drepturilor legale, concilierea vie\u021bii profesionale cu cea de familie, locuri de munc\u0103 \u0219i venituri mai stabile, o influen\u021b\u0103 mai mare la locul de munc\u0103 \u0219i participarea la procesele decizionale.<\/p>\n<p>Pentru angajatori, negocierea colectiv\u0103 aduce avantaje privind asigurarea p\u0103cii sociale \u0219i a unui climat de munc\u0103 favorabil performan\u021bei, productivitatea \u0219i loialitatea personalului \u00eembun\u0103t\u0103\u021bite,participarea mai mare a for\u021bei de munc\u0103 la locul de munc\u0103, eficacitate \u0219i planificare bugetar\u0103, rezolvarea timpurie a litigiilor.<\/p>\n<p><strong>Ne\u00eendeplinirea<\/strong>\u00a0de c\u0103tre angajatori a obliga\u021biei privind negocierea colectiv\u0103 constituie contraven\u021bie \u0219i se sanc\u021bioneaz\u0103 cu <strong>amend\u0103<\/strong>\u00a0de \u00a0la 15.000 lei la 20.000
